These Terms of Service ("Terms") govern your access to and use of the website located at alzbloodtest.com and all related services (collectively, the "Services").
The Services are operated by Kahn Professional PLLC, a Nevada professional limited liability company, doing business as ALZ Blood Test ("ALZ," "Company," "we," "us," or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
Our Privacy Policy is incorporated by reference.
1. Nature of Services
ALZ Blood Test provides a physician-directed laboratory testing access platform for certain Alzheimer's-related biomarkers, including but not limited to the pTau 217 blood test.
The Services include:
- Online prequalification screening
- Patient intake collection
- Physician review and automated test authorization
- Transmission of requisitions to a contracted CLIA-certified laboratory (e.g., Neurocode)
- Coordination of test kit shipment
- Result routing and delivery
ALZ Blood Test is not a clinical laboratory.
Laboratory analysis is performed by independent CLIA-certified laboratories.
2. Physician Authorization & Automated Prescription Model
Test orders are placed through ALZ's online platform and are subject to medical eligibility screening.
As part of the ordering process:
- You must complete required prequalification questions.
- You must affirm eligibility criteria.
- You must provide accurate medical information.
If eligibility criteria are satisfied, the order is transmitted through ALZ's integrated ELIS platform.
Receipt of a valid requisition by the laboratory constitutes physician authorization for the automated processing of the ordered test(s) pursuant to standing authorization agreements between ALZ and the laboratory.
By submitting an order, you acknowledge that:
- A licensed physician affiliated with Kahn Professional PLLC authorizes the test.
- The authorization is limited to the specific ordered test.
- The physician's role is limited to test authorization unless otherwise expressly stated.
No ongoing physician-patient relationship is established beyond test authorization and related communications.
3. Eligibility & Representations
By ordering a test, you represent that:
- You are at least 18 years old.
- You have not received a prior confirmed diagnosis of Alzheimer's disease (unless otherwise disclosed).
- You do not have known chronic kidney disease or reduced kidney function.
- All information provided is accurate and complete.
You acknowledge that failure to provide accurate information may invalidate test authorization.
4. No Medical Diagnosis or Treatment
The pTau 217 test assesses biomarkers associated with Alzheimer's-related pathology risk.
A positive or elevated result:
- Does not independently diagnose Alzheimer's disease.
- Does not constitute a final medical diagnosis.
- May require follow-up evaluation.
You agree not to make medical decisions solely based on test results without consulting a licensed healthcare provider.
All website content is informational only and does not constitute medical advice.
5. Voluntary Testing & Informed Acknowledgment
By placing an order, you acknowledge:
- The test is ordered voluntarily.
- Results may indicate risk or predisposition only.
- Additional evaluation may be recommended.
- Emotional or psychological reactions to results are possible.
- You are responsible for seeking appropriate medical follow-up.
6. Orders, Shipment & No Refund Policy
Once a test kit has been shipped, all sales are final.
Due to the medical, laboratory, administrative, and allocation costs incurred upon shipment, refunds are not provided once a kit has been shipped, regardless of whether the specimen is collected or submitted.
Orders canceled prior to shipment may be eligible for a refund at our sole discretion, less applicable processing fees.
Returned kits are not accepted.
Nothing in this section limits any non-waivable rights under applicable law.
7. Specimen Collection & Stability
You are responsible for:
- Following all kit instructions
- Submitting specimens within required timeframes
- Proper packaging and shipment
We are not responsible for:
- Delays caused by shipping carriers
- Improper specimen collection
- Expired or compromised samples
Laboratory rejection due to specimen issues may require a new order.
8. Communications & Electronic Consent
By providing your contact information, you consent to:
- Administrative communications (order confirmations, results notices, scheduling updates)
- Physician-related communications, if necessary
- Educational materials
- Marketing communications (where permitted)
You agree that electronic communications satisfy legal requirements for written notice.
You may opt out of marketing communications at any time.
9. Privacy & HIPAA
Protected Health Information is handled consistent with our Privacy Policy and applicable law.
Laboratory partners and clinical systems operate under applicable compliance obligations.
10. Acceptable Use
You agree not to:
- Submit false medical information
- Attempt unauthorized system access
- Interfere with platform security
- Use Services in violation of law
We reserve the right to suspend or terminate access for violations.
11. Intellectual Property
All website materials, trademarks, logos, text, graphics, and software are owned by or licensed to ALZ Blood Test.
Unauthorized use is prohibited.
12. Disclaimer of Warranties
The Services are provided "as is" and "as available."
We make no warranties regarding:
- Laboratory turnaround times
- Continuous availability
- Predictive accuracy of biomarker results
- Clinical outcomes
To the fullest extent permitted by law, we disclaim all implied warranties.
13. Limitation of Liability
To the fullest extent permitted by law:
ALZ Blood Test, its physicians, affiliates, contractors, and partners shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Emotional distress
- Medical decisions made based on results
- Delays caused by third parties
Total liability shall not exceed the amount paid for the specific test at issue.
14. Indemnification
You agree to indemnify and hold harmless ALZ Blood Test from claims arising from:
- Misuse of the Services
- False information provided
- Medical decisions made without professional consultation
- Violation of these Terms
15. Arbitration & Governing Law
These Terms are governed by the laws of the State of Nevada.
Any dispute shall be resolved through binding arbitration in Clark County, Nevada under the rules of the American Arbitration Association.
You waive the right to participate in class or collective actions.
This arbitration provision does not limit any rights that cannot legally be waived.
16. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including laboratory delays, shipping disruptions, regulatory changes, cyber incidents, or natural disasters.
17. Severability
If any provision is deemed unenforceable, the remaining provisions remain in effect.
18. Changes to Terms
We may update these Terms at any time. Continued use of the Services constitutes acceptance of updated Terms.
